BC is experiencing a reversal on both reconciliation and Aboriginal Title. The reversal on reconciliation is highlighted by the Provincial approach toward UNDRIP after the initial legislation. The BC reversal is attributable to the Cowichan which recognized Aboriginal title for the Cowichan Tribes over lands in Richmond, B.C, marking a historic precedent in Canadian law. The implications for fee simple lands was the spark that set off the Provincial opposition. Misconceptions lead to opposition. The Haida/BC decision is a prime example of how fear by the municipalities of losing authority was exaggerated. In a practical sense the municipalities from Queen Charlotte City up to Old Masset have their same authority and responsibilities. The only difference is the role the Haida now play with respect to Crown Lands.

The issue of not allowing Cannabis sales on Reserve is controversial. Why should the Province be the sole vendor. The issue of Section 35 rights is the main focus for many communities in legitimizing the sale of cannabis on Reserve.
